Sans préjudice des dispositions plus favorables résultant d'accords internationaux ratifiés par la France, une dérogation générale est apportée à la prohibition d'importation prévue par l'article L. 2335-1 du code de la défense1 pour :

a) Les matériels, armes, éléments d'arme, munitions ou éléments de munition importés sous les régimes douaniers suspensifs pour réparation ou d'admission temporaire pour essais ou expériences ;…

c) Les matériels, armes, éléments d'armes, munitions ou éléments de munitions importés sous le régime de transit, transbordés de bord à bord sans mise à terre dans les ports ou aérodromes de la Nouvelle-Calédonie, ainsi que les matériels, armes, éléments d'armes, munitions ou éléments de munitions transbordés de bord à bord avec mise à terre dans les ports ou aérodromes de la Nouvelle-Calédonie dans les cas énumérés ci-après :

1° Lorsqu'il s'agit d'armes, de munitions et leurs éléments de la 1re2 ou de la 4e3 catégorie détenus ou portés par des personnes physiques qui changent d'aéronef ou de navire et qui ont été autorisées par leurs autorités nationales à les détenir ou les porter ;
2° Lorsqu'il s'agit d'armes, de munitions et leurs éléments de la 5e catégorie4 ou d'armes de la 6e catégorie.5

Cette dérogation pourra être suspendue par décision du haut-commissaire de la République ;

d) Les matériels, armes, éléments d'arme, munitions ou éléments de munition réimportés par les exportateurs au bénéfice du régime douanier des retours ou en suite de régime d'exportation temporaire ;

e) Deux armes de chasse du I de la 5e catégorie importées sous le régime douanier de l'admission temporaire et cent cartouches par arme ;

f) Les armes de poing et les munitions dont le port est autorisé par arrêté du ministre de l'intérieur en application de l'article 71;…6

Article 94

Without prejudice to more favourable provisions resulting from international agreements, ratified by France, a general exception is made to the import prohibition provided for in Article L. 2335-1 of the Defence Code1 for:

a) Equipment, firearms, components of firearms, ammunition or components of ammunition imported under the suspensive Customs regimes for repair or of temporary admission for trials or experiences;…

c) Equipment, firearms, components of firearms, ammunition or components of ammunition imported under the transit regime, transhipped from board to board, without touching the ground in ports or airfields of New Caledonia, as well as equipments, firearms, components of firearms, ammunition or components of ammunition transhipped from board to board while touching the ground in ports or airfields of New Caledonia, in cases listed below:

1. When it concerns firearms, ammunition and their components of the 1st2 or 4th3 categories, held or carried by individuals who are switching airplane or ship and who have been authorised by their national authorities to hold or to carry them;
2. When it concerns firearms, ammunition and their components of the 5th category,4 or weapons of the 6th category.5

This exception may be suspended by decision of the High Commissioner of the Republic;

d) Equipment, firearms, components of firearms, ammunition or components of ammunition, re-imported by the exporters to the benefit of the Customs regime on returns, or as a result of the inward processing regime.

e) Two hunting firearms of paragraph I of the 5th category that are imported under the Customs regime of temporary admission, and a hundred cartridges per firearm.

f) Handguns and ammunition for which carrying is authorised by order of the Minister of Interior in application of Article 71; …6
