Article 70

Le ministre de l'intérieur peut autoriser par arrêté toute personne exposée à des risques exceptionnels d'atteinte à sa vie, sur sa demande, à porter et transporter une arme de poing relevant d'une catégorie et présentant certaines caractéristiques et, dans les limites fixées au premier alinéa du I de l'article 39,1 les munitions correspondantes.

L'autorisation, délivrée pour une période qui ne peut excéder un an, est renouvelable. Elle peut être retirée à tout moment.

Le haut-commissaire de la République en Nouvelle-Calédonie délivre au titulaire de cette autorisation de port d'arme, sur présentation du certificat médical visé au 1° de l'article 43,2 l'autorisation d'acquérir et de détenir, pour la même durée, l'arme de poing et, dans les limites prévues au premier alinéa du I de l'article 39, les munitions correspondantes. En cas de retrait ou de non-renouvellement de l'autorisation de port d'arme, l'autorisation d'acquisition et de détention d'arme devient aussitôt caduque. Son titulaire se dessaisit alors de l'arme et des munitions dans les conditions définies à l'article 84.3

Article 70

The Minister of Interior may authorise by order, any individual exposed to exceptional risks of harm to his/her life, upon his/her request, to carry and transport a handgun of a category and with certain characteristics, and within the limits set in the first paragraph of I of Article 39,1 the corresponding ammunition.

The authorisation, issued for a period of time not exceeding one year, is renewable. It may be withdrawn at any time.

The High Commissioner of the Republic of New Caledonia issues, to the holder of this authorisation to carry firearms, upon presentation of a health certificate referred to in 1- of Article 43,2 the authorisation to purchase and to possess, for the same period of time, the handgun and, within the limits set in the first paragraph of I of Article 39, the corresponding ammunition. In case of withdrawal or of non-renewal of the authorisation to carry firearms, the authorisation to purchase and to possess firearms becomes null and void. Its holder must surrender the firearm and ammunition under conditions defined in Article 84.3
