Chapitre V: Importations et exportations

Section 1: Importations et exportations des matériels de guerre et matériels assimilés hors du territoire de l'Union européenne

Article L. 2335-3:

I. L'autorisation préalable d'exportation, dénommée licence d'exportation, est accordée par l'autorité administrative, sous l'une des formes suivantes:

1° Des arrêtés dénommés "licences générales d'exportation", comportant des listes de matériels et autorisant directement tout exportateur établi en France remplissant certaines conditions définies par l'autorité administrative à expédier ces matériels vers une ou plusieurs catégories de destinataires situés dans un Etat non membre de l'Union européenne ainsi que dans les territoires exclus du territoire douanier de l'Union européenne;
2° Des licences globales d'exportation, faisant l'objet d'une notification, autorisant, à sa demande, un exportateur établi en France à expédier des matériels de guerre et matériels assimilés spécifiques à un ou plusieurs destinataires identifiés, situés dans un Etat non membre de l'Union européenne ainsi que dans les territoires exclus du territoire douanier de l'Union européenne, pour une durée déterminée, sans limite de quantité ni de montant;
3° Des licences individuelles d'exportation, faisant l'objet d'une notification, autorisant, à sa demande, un exportateur établi en France à expédier, en une ou plusieurs fois, un ou plusieurs matériels de guerre et matériels assimilés à un destinataire situé dans un Etat non membre de l'Union européenne ainsi que dans les territoires exclus du territoire douanier de l'Union européenne.

Les licences d'exportation peuvent comporter des conditions ou des restrictions concernant l'utilisation finale de ces matériels.

II. Les licences générales d'exportation autorisent tout exportateur établi en France à effectuer des exportations de matériels de guerre et matériels assimilés, y compris toutes les opérations commerciales préalables.

III. Les licences globales et les licences individuelles d'exportation autorisent un exportateur établi en France à procéder à l'exportation de matériels de guerre et matériels assimilés, y compris toutes les opérations commerciales préalables…

V. Aucun exportateur des matériels appartenant aux catégories A¹ et B² mentionnées à l'article L. 2331-1³ ne peut utiliser une licence générale d'exportation ou obtenir une licence globale ou individuelle d'exportation s'il n'est déjà titulaire de l'autorisation prévue au I de l'article L. 2332-1.⁴

Les personnes non titulaires de cette autorisation peuvent, à titre exceptionnel, demander à bénéficier d'une licence générale, globale ou individuelle d'exportation des matériels de catégories A et B.

VI. Les modalités d'application du présent article sont déterminées par décret en Conseil d'Etat.

Chapter V: Imports and Exports

Section 1: Imports and Exports of Weapons of War and Related Materials Outside of the European Union Territory

Article L. 2335-3:

I. The prior export authorisation, called an export licence, is granted by the administrative authority in one of the following forms:

1° Orders referred to as "general export licences", which include lists of materials and authorise any exporter settled in France, complying with certain conditions defined by the administrative authority, to directly send these materials towards one or many categories of recipients located in a non-member State of the European Union, as well as territories excluded from the customs territory of the European Union;
2° Global export licences subject to notification, which authorise upon his [the exporter] request, an exporter settled in France to send weapons of war and specific related materials towards one or many identified recipients, located in a non-member State of the European Union, as well as territories excluded from the customs territory of the European Union, for a limited period, without limit on quantity or amount;
3° Individual export licences subject to notification, which authorise upon his [the exporter] request, an exporter settled in France to send, on one or many occasions, one or many weapons of war or related materials to a recipient located in a non-member State of the European Union, as well as territories excluded from the customs territory of the European Union.

Export licences may contain conditions or restrictions concerning the end-use of exported materials.

II. General export licences authorise any exporter settled in France to carry out exports of weapons of war and related materials, including any prior commercial operations.

III. Global export licences and individual export licences authorise an exporter settled in France to proceed to the export of weapons of war and related materials, including any prior commercial operations…

V. No exporter of materials of categories A¹ and B² mentioned in Article L. 2331-1,³ may use a general export licence or obtain a global or individual export licence if he is not already the holder of the authorisation provided for in Article L. 2332-1, I.⁴

Individuals not holding this authorisation may request, in exceptional cases, a general, global or individual export licence for materials of categories A and B.

VI. Implementing conditions of this Article are set by Decree in State Council.
