Autorisation d'Exportation
Le certificat de destination finale doit comporter une clause de non-réexportation selon laquelle l'acquéreur s'engage à ne pas réexporter les biens visés sans accord préalable des autorités belges. Cette condition indispensable permet d'éviter tout détournement ou réexportation vers une autre destination que celle prévue à la demande initiale. Par ailleurs, nos Ambassades procèdent, en plus d'une légalisation de la signature (End-User), à une vérification de fond des éléments de l'opération projetée, qui ne peut être effectuée que sur place auprès des autorités locales concernées.
Il est à noter que toute réexportation doit faire l'objet d'une autorisation préalable des autorités belges. Cette responsabilité est prise par l'expéditeur, qui s'engage d'effectuer l'exportation selon les conditions de la licence et par l'utilisateur final qui doit souscrire telle obligation dans son certificat d'utilisateur final.

Authorisation for Export
The end-user certificate must contain a clause prohibiting re-export according to which the purchaser agrees not to re-export the goods without prior authorisation of the Belgian authorities. This requirement prevents any diversion or re-export to a destination other than that provided in the original application. Moreover, our Embassies shall, in addition to a legalisation of the signature (End-User), proceed to carry out background checks on the transaction, which can only be performed on site with the local authorities concerned.
It is important to note that any re-export is subject to the preliminary authorisation of the Belgian authorities. The end-user, who must conform to the obligation in his end-use certificate, and the sender both take the responsibility to carry out the export under the conditions of the authorisation.
