Article 9

La licence d'importation, d'exportation ou de transit (visée dans ce titre) peut être refusée pendant une période de un à six mois, selon les règles que le Roi établit par arrêté délibéré en Conseil des ministres, à l'égard de toute personne physique ou morale qui:

- sans licence valable, importe, exporte ou fait passer en transit ou tente d'importer, d'exporter ou de faire passer en transit des armes, des munitions ou du matériel devant servir spécialement (à un usage militaire ou de maintien de l'ordre) et de technologie y afférente;

- importe, exporte ou fait passer en transit ou tente d'importer, d'exporter ou de faire passer en transit des armes, des munitions ou du matériel devant servir spécialement (à un usage militaire ou de maintien de l'ordre) et de technologie y afférente dont l'importation, l'exportation et le transit sont interdits en vertu de la présente loi et de ses mesures d'exécution;

- s'est livrée ou a participé à un détournement de trafic en ce qui concerne des armes, des munitions ou du matériel devant servir spécialement (à un usage militaire ou de maintien de l'ordre) et de technologie y afférent en infraction aux mesures prises en exécution de l'article 4 de la présente loi;

- a fourni des informations inexactes ou incomplètes en vue d'obtenir des licences d'importation, d'exportation ou transit d'armes, de munitions ou de matériel devant servir spécialement (à un usage militaire ou de maintien de l'ordre) et de technologie y afférente;

Law of 5 August 1991 on Import, Export, Transfer and the Fight against Trafficking of Weapons, Ammunition and Material Intended Specifically for Military Use or Law Enforcement and Corresponding Technology

Article 9

The license for importation, exportation or transfer (referred to in this title) may be denied during a period of one to six months, according to the rules established by the King by bylaw deliberated by the Council of Ministers, concerning any natural or legal person who:

- without a valid licence, imports, exports or transfers or attempts to import, export or transfer weapons, ammunition or material intended specifically (for military use or law enforcement) and corresponding technology;

- imports, exports or transfers or attempts to import, export transfer weapons, ammunition or material intended specifically (for military use or law enforcement) and corresponding technology, of which the importation, exportation and transfer are prohibited according to the present Law and its implementing measures;

- has engaged or participated in a trafficking diversion concerning weapons, ammunition and material intended specifically (for military use or law enforcement) and corresponding technology contrary to the implementing measures of Article 4 of the present Law;

- Has supplied incorrect or incomplete information in order to obtain licences for importation, exportation or transfer of weapons, ammunition or material specifically intended (for use military or law enforcement) and related technology…
