Article 4

4. Each Member State shall establish a system for the regulation of the activities of dealers and brokers. Such systems shall include at least the following measures:
(a) the registration of dealers and brokers operating within the territory of that Member State;
(b) the licensing or authorisation of the activities of dealers and brokers within the territory of that Member State; and (c) a check of the private and professional integrity and of the relevant abilities of the dealer or broker concerned. In the case of a legal person, the check shall be both on the legal person and on the natural person or persons directing the undertaking.
