Section 1: Importations et exportations des matériels de guerre et matériels assimilés hors du territoire de l'Union européenne

Article 2335-6:

Les exportateurs de matériels de guerre et matériels assimilés tiennent, dans des conditions déterminées par l'autorité administrative, un registre des exportations qu'ils ont effectuées.

Le registre des exportations ainsi que l'ensemble des documents commerciaux nécessaires à leur réalisation sont conservés pendant dix ans à compter de la fin de l'année civile au cours de laquelle l'exportation a eu lieu.

Les exportateurs sont également tenus de transmettre à l'administration un compte rendu des prises de commande et des exportations effectuées. Les importateurs sont tenus de transmettre à l'administration un compte rendu des importations effectuées. L'autorité administrative définit le contenu de ce document, la périodicité de sa transmission et la liste des catégories de matériels concernées par cette obligation…

Sans préjudice des compétences du ministre chargé des douanes, le ministre de la défense exerce le contrôle du respect des obligations définies à la présente sous-section.

Les modalités d'application du présent article sont déterminées par décret en Conseil d'Etat.

Chapter V: Imports and Exports

Section 1: Imports and Exports of Weapons of War and Related Materials Outside of the European Union Territory

Article 2335-6:

Exporters of weapons of war and related materials must keep, under conditions set by the administrative authority, a register of the exports that they carried out.

The exports register, as well as all necessary commercial documents, are kept for ten years starting from the end of the civil year when the export took place.

Exporters must also submit to the administration a report of order intakes and of conducted exports. Importers must submit to the administration a report of the imports conducted. The administrative authority defines the content of this document, the periodicity of its transmission and the list of categories of materials concerned by this obligation….

Without prejudice to competences of the Minister in charge of Customs, the Minister of Defence exerts control over the compliance with these obligations referred to in this sub-section.

Implementing conditions of this article are set by Decree in State Council.
