De las infracciones a esta ley y su sanción

Articulo 36 - Toda violación de las prohibiciones o incumplimiento de las obligaciones que establecen esta ley y su reglamentación, serán sancionadas por las autoridades de fiscalización que corresponda, de acuerdo a lo determinado por el artículo 4, mediante la aplicación separada o conjunta, según el caso, de las penalidades que a continuación se enuncian:

1) Apercibimiento administrativo formal.
2) Multa de CUATRO MIL PESOS ($4.000) a CUATROCIENTOS MIL PESOS ($400.000) tratándose de particulares o responsables individuales.
3) Multa de CUARENTA MIL PESOS ($40.000) a CUATRO MILLONES DE PESOS ($4.000.000) en caso de comercios, industrias, fábricas, minas, obras, importadores, exportadores o responsables comerciales o colectivos.
4) Suspensión temporaria en el registro o autorización concedida, entre un (1) mes y un (1) año para legítimos usuarios individuales y de tres (3) días a un (1) año, en caso de comercios, industrias, fábricas, minas, obras, importadores, exportadores, o responsables comerciales o colectivos.
5) Clausura del local o lugar de operación donde funcione el comercio, industria, fábrica, mina, obra, etc., entre tres (3) días y siete (7) meses.
6) Decomiso del material de infracción. Modificado por:

Articulo 37 - En caso de concurrencia de dos o más infracciones, el límite máximo de los importes de las multas previstas en los incisos 2 y 3 y de los términos de suspensión y clausura contemplados en los incisos 4 y 5, todos del artículo anterior, se elevarán al doble.
Las multas aplicadas por resolución firme, deberán ser dobladas en el término que establezca la reglamentación. No verificándose su pago dentro del plazo que se determine, las mismas serán ejecutables por la vía que establecen los artículos 604 y 605 del Código Procesal Civil y Comercial de la Nación (Ley 17.454), sirviendo de suficiente título la resolución que impuso la multa o su copia debidamente autenticada.

Violations of this Law and Penalties

Article 36 - Any violation of the prohibitions or breach of any of the obligations under this Act and its regulations shall be punished by the authorities, as determined by Article 4, through separate or joint application, and the penalties set out hereunder:

1) Administrative warning letter.
2) A fine of four thousand pesos ($4,000) to four hundred thousand pesos ($400,000) for the responsible individual or individuals.
3) A fine of forty thousand pesos ($40,000) to four million pesos ($4,000,000) in cases regarding businesses, industries, factories, mines, workers, importers, exporters and trade officials.
4) Temporary suspension in the registry or authorisation granted between one (1) month and one (1) year for legitimate individual users and three (3) days to one (1) year in cases of businesses, industries, factories, mines, construction sites, importers, exporters or commercial or collective responsibility.
5) Closure of the locale or the place where commerce, industry, factory, mine, work, etc. takes place between three (3) days and seven (7) months.

Article 37 - In case of two or more offences reoccurring, the maximum fine provided for in paragraphs 2 and 3 and the terms of suspension and closure referred to in paragraphs 4 and 5 shall double. The fines imposed by a final decision shall be folded into the term established by the regulations. Articles 604 and 605 of the code of civil and commercial procedure (Act 17.454) shall be referred to if payment is not made within the determined period.
