Le Décret B.A.S.1877.143 du 06 Mai 1877 portant Code Pénal, l'Ordonnance N°25/M.J.L du 07 Août 1967 portant Code de Procédure Pénale et le Décret N°61/39/PR/MI/AM du 07 Février 1961 fixant le régime des Armes et Munitions en République du Bénin sont les textes appliqués aux contrevenants.

Les infractions liées à la détention et au port illégal d'arme à feu constituent des contraventions et sont punies d'une amende variant entre 300 F et 36.000 Francs CFA. Les armes en situation illicite sont confisquées.

Les Lois en élaboration prévoient des peines sévères pour les mêmes infractions afin de prévenir et de décourager au besoin toutes sortes de trafic illicite d'ALPC sur l'ensemble du territoire national.

Law Enforcement and Criminalisation

The Decree of 6 May 1877 BAS1877.143 on the Penal Code, the Ordinance No. 25/MJL of 7 August 1967 on the Code of Criminal Procedure and Decree No. 61/39/PR/MI/AM of 7 February 1961 laying down the rules on weapons and ammunition in the Republic of Benin are the laws applicable to offenders.

Offences concerning illegal possession and carrying of a firearm constitute violations and are punishable with a fine of between 300 and 36,000 CFA Francs. The illegal weapons are confiscated.

The laws that are being developed include serious penalties for the same offence to prevent and discourage all kinds of illicit trafficking of SALW throughout the country.
