Lois, réglementations et procédures administratives
Actuellement deux textes réglementant la gestion des armes restent encore en vigueur. Il s'agit:
- du Décret B.A.S.1877.143 du 06 Mai 1877 portant Code Pénal applicable en Afrique Occidentale Française;
- et du Décret N° 61/39/PR/MI/AM du 07 Février 1961 fixant le régime des Armes et Munitions en République du Bénin (Journal Officiel 1961, page 164).
Selon ce dernier texte, le commerce des armes perfectionnées de toutes catégories est interdit en République du Bénin, mais le commerce des munitions de chasse peut être autorisé par le Ministère de l'Intérieur sur demande des Maisons de commerce.
Toutefois, les Maisons de commerce pourront seulement être spécialement autorisées à servir d'intermédiaire pour l'exécution hors du Bénin des commandes faites par des personnes préalablement autorisées à importer et détenir en République du Bénin une arme de chasse perfectionnée.
Les armes de fabrication artisanale constituent des armes de traite et ne sont pas prises en compte par les textes en vigueur.
La révision du Code Pénal est en cours. Un texte de loi devant remplacer le Décret fixant le régime des Armes et Munitions est aussi en cours d'élaboration.

Laws, Regulations and Administrative Procedures
Currently, two laws regulating the management of firearms are in force. These are:
- Decree of 6 May 1877 BAS1877.143 with the Penal Code applicable in French West Africa;
- And Decree No. 61/39/PR/MI/AM of 7 February 1961 laying down the rules on arms and ammunition in the Republic of Benin (Official Journal 1961, page 164).
According to the latter text, the trade in sophisticated weapons of all categories is prohibited in the Republic of Benin, but trade in hunting ammunition can be authorised by the Ministry of the Interior by applying to trade houses.
However, trade houses may only be authorised to act as an intermediary to carry out orders made by persons previously authorised to import and possess a sophisticated hunting firearm in the Republic of Benin.
Homemade firearms are considered to be slave trade firearms [craft weapons, or weapons for exchange], and are not included in the laws in force.
A review of the Penal Code is under way. A Law aiming to replace the Decree laying down the rules on arms and ammunition is currently being elaborated.
