La principauté d'Andorre rappelle que la législation actuelle en matière d'armes est reprise par le Décret sur la possession, l'utilisation et la circulation d'armes du 03/07/1989 et les articles 263, 264 et 265 du Code Pénal andorran.
D'autres lois complètent ce cadre juridique:
- Loi 5/2004 - Code de la Douane Andorrane, du 14 avril 2004 (le code établi entre autres le port d'arme pour les agents des douanes andorranes)
- Loi 8/2004 - Loi sur le corps de la police, du 27 mai 2004 (la loi régule entre autres les port d'arme pour les agents de la police andorrane)
- Loi de chasse, du 13 avril 2000 (la loi définit entre autres les attributions du service des Banders)
- Échange de notes du 22 février 2005 constituant un accord bilatéral entre le Gouvernement de la principauté d'Andorre et le Royaume d'Espagne sur la reconnaissance réciproque des permis d'armes de chasse et de tir sportif.
Force est de constater que, le Code Pénal prévoit une série de dispositions pénales le Chapitre III qui sanctionnent le non respect des obligations établies par le Décret.
Le Décret de 1989 réglemente les importations, les exportations, les exportations temporaires ainsi que la circulation d'armes dans la Principauté. Les importations d'armes sont contrôlées par le Service des Douanes et c'est le Directeur de la Police qui définit les catégories et les types d'armes qui sont autorisées à être importées en Andorre.
Le Décret régule aussi le système d'octroi de licences pour les armes et les vendeurs d'armes. En ce sens, les armureries andorranes peuvent vendre des armes de 1ère et de 2ème catégorie (armes et munitions) uniquement aux titulaires d'une autorisation d'acquisition.
Pour la vente de munitions, si l'acheteur est titulaire d'un permis de port ou de possession d'arme, la munition lui sera remise directement à l'armurerie. Si l'acheteur est étranger et non résident, la livraison des munitions se fera au bureau central de la Police.

Information Concerning the Implementation of the Programme of Action at the National Level
The Principality of Andorra recalls that the current weapon legislation is contained in the Decree on the Possession, Use and Transport of Weapons of 3 July 1999 and in articles 263, 264 and 265 of the Andorran Penal Code. This legislative framework is complemented by other laws:
– Act No. 5/2004, the Andorran Customs Code of 14 April 2004, which, inter alia, authorizes Andorran Customs officials to bear arms;
– Act No. 8/2004, the Police Force Act of 27 May 2004, which, inter alia, regulates the carrying of firearms by Andorran Police officers;
– The Hunting Act of 13 April 2000, which, inter alia, establishes the competencies of the Banders; and
– The exchange of notes of 22 February 2005 constituting a bilateral agreement between the Principality of Andorra and the Kingdom of Spain on the reciprocal recognition of weapon permits for hunting and sport shooting.
It should be pointed out that the penalties for violations of the terms of the Decree are set forth in Chapter 3 of the Penal Code.
The Decree of 1989 regulates the import, export, temporary export and movement of weapons in the Principality. Weapon imports are monitored by the Customs Department. The Chief of Police establishes the categories and types of weapons that may be imported into Andorra.
The Decree also regulates the licensing system and weapon vendors. Thus, Andorran weapon vendors may sell category 1 and 2 weapons (weapons and ammunition) only to persons who have been granted authorization to purchase them.
As regards the sale of ammunition, purchasers with a licence to bear or own weapons may receive ammunition directly from the vendor. Non-resident foreign purchasers must collect it from the central police station.
