A-4.1. Dispositions pénales:
Les mesures législatives érigeant en infraction pénale, au regard du droit national, la fabrication, la détention, la possession, le stockage et le commerce illicites des ALPC, sont résumées ci-dessous:
- L'ordonnance n° 95-11, modifiant et complétant l'Ordonnance no 66-156 du 08 juin 1966 portant Code pénal a introduit l'article 87 bis 7, qui incrimine et punit la détention, la soustraction, le port, la commercialisation, l'importation, l'exportation, la fabrication et la réparation illicites des armes prohibées et les munitions d'une peine de réclusion à temps de 10 à 20 ans et d'une amende de 500,000 DA à 2,000,000 DA;
- Les dispositions de l'ordonnance n° 97-06 du 21 janvier 1997 relative aux matériels de guerre, armes et munitions prévoient:
- article 26: la réclusion perpétuelle pour quiconque fabrique, importe, exporte, ou fait le commerce sans autorisation de l'autorité dûment habilitée, des matériels de guerre, armes et munitions de 1ère, 2 ème et 3 ème catégories;
- article 27: la réclusion à temps de 10 à 20 ans assortie d'une amende de 1,000,000 à 5,000,000 de dinars algériens pour quiconque fabrique, importe, exporte, ou fait le commerce sans autorisation de l'autorité dûment habilitée, des armes et munitions, ainsi que les matériels et équipements de la 4ème catégorie;
- article 28: la réclusion à temps de 5 à 10 ans assortie d'une amende de 1,000,000 à 2,000,000 de dinars algériens pour quiconque fabrique, importe, exporte, ou fait le commerce sans autorisation de l'autorité dûment habilitée, des armes et munitions, ainsi que les matériels et équipements de la 5ème catégorie;
- article 29: l'emprisonnement de 6 mois à 2 ans assortie d'une amende de 50,000 à 200,000 dinars algériens pour quiconque sans autorisation de l'autorité dûment habilitée, procède pour son usage personnel, à la fabrication d'armes ou de munitions de la 5ème catégorie;
- article 30: l'emprisonnement de 2 à 5 ans assortie d'une amende de 200,000 à 500,000 dinars algériens pour quiconque fabrique, procède pour son usage personnel, importe, exporte ou fait le commerce, sans autorisation de l'autorité dûment habilitée des armes et munitions des 6ème, 7ème et 8ème catégories.

A-4.1. Penal Provisions:
The legislation criminalising, under national law, the manufacture, holding, possession, stockpiling and the illicit trade of SALW, are summarized below:
- Ordinance No. 95-11 amending and supplementing Ordinance No. 66-156 of 8 June 1966 on the Penal Code introduced Article 87 bis 7, which criminalizes and punishes possession, theft or diversion, carrying, offering for sale, the import, export, manufacture and repair of illegal and prohibited weapons and ammunition by a sentence of 10 to 20 years and a fine of 500,000 to 2,000,000 AD;
- The provisions of Ordinance No. 97-06 of 21 January 1997 on military equipment, weapons and ammunition include:
- Article 26: life imprisonment for anyone who manufactures, imports, exports, or trades without the authorisation of the duly empowered authority, military equipment, weapons and ammunition of the 1st, 2nd and 3rd categories;
- Article 27: Imprisonment from 10 to 20 years and a fine from 1,000,000 to 5,000,000 Algerian dinars for anyone who manufactures, imports, exports, or trades without the authorisation of the duly empowered authority, weapons and ammunition and materials and equipment of the 4th category;
- Article 28: Imprisonment from 5 to 10 years and a fine from 1,000,000 to 2,000,000 Algerian dinars for anyone who manufactures, imports, exports, or trades without the authorisation of the duly empowered authority, weapons and ammunition as well as materials and equipment of the 5th class;
- Article 29: Imprisonment from 6 months to 2 years and a fine from 50,000 to 200,000 Algerian dinars to anyone trading without the authorisation of the duly empowered authority, proceeds to the manufacture of weapons or ammunition of the 5th category for personal use;
- Article 30: Imprisonment from 2 to 5 years and a fine from 200,000 to 500,000 Algerian dinars for anyone who manufactures, imports, exports or trades without the authorisation of the duly empowered authority weapons and ammunition of the 6th, 7th and 8th categories.
