Artículo 112

Tenencia Ilegal de Armas de Fuego Bélicas o de Uso Exclusivo del Ejército de Guatemala o de las Fuerzas de Seguridad y Orden Público del Estado, Explosivos, Armas Químicas, Biológicas, Atómicas, Trampas Bélicas y Armas Experimentales

Comete el delito de tenencia ilegal de armas de fuego bélicas o de uso exclusivo del Ejército de Guatemala o de las fuerzas de seguridad y orden público del Estado, explosivos, armas químicas, biológicas, atómicas, trampas bélicas y armas experimentales, quien tenga una o más armas de esta clase sin estar autorizado.

El responsable de este delito será sancionado con prisión de diez (10) a quince (15) años inconmutables y comiso de las armas.

Artículo 113. Tenencia Ilegal de Armas de Fuego Artesanales o Hechizas, Armas con Número de Registro Alterado, Armas con Número Borrado o No Legalmente Marcadas por la DIGECAM

Comete delito de tenencia ilegal de armas de fuego con números de registro alterado, borrado o no legalmente marcado, la persona que tenga una o más armas en cualquiera de las condiciones mencionadas.

El responsable de este delito será sancionado con prisión de cinco (5) a ocho (8) años inconmutables, y comiso de las armas.

Si las armas fueran de las contempladas en esta Ley como armas artesanales o hechizas, la pena se aumentará en una tercera parte.

Article 112. Illegal Possession of Military Weapons or for the Sole Use of the State Forces

The crime of illegal possession of military weapons or for the sole use of the Army or the State security forces, explosives, chemical, biological, nuclear and experimental weapons and military traps, is committed by those who have one or more of such weapons without authorisation.

This crime will be punished with imprisonment from ten to fifteen years, commutably, and confiscation of weapons.

Article 113. Illegal Possession of Homemade or Crafted Firearms; Guns with Altered or Deleted Registration Number; and Arms Not Legally Marked by the Office for Arms and Ammunition Control

The crime of illegal possession of firearms with altered or deleted registration number or illegally marked, is committed by the person that has one or more guns in any of these conditions.

This crime will be punished with imprisonment from five to eight years, commutably, and confiscation of weapons.

If the firearms were those classified in this Law as crafted or homemade, the penalty will be increased by a third.
