Brokering
The act on the export and import of military and non-military lethal goods regulates the issue of brokering services. The brokering services may be carried out by persons registered for the activity of agency on domestic and foreign market in goods listed in the Common Military List with the headquarter in the territory of the Republic of Croatia and registered in the Register of providers of services for military goods. The Register is kept in the Ministry of the Economy, Labour and Entrepreneurship. Entry in the Register shall be carried out based on written request of the person.The request shall be accompanied by the set forth documents. The Ministry shall deny the registration in the Register if the person fails to meet all the set forth conditions.
Prior to starting with providing the services the person entered into the Register shall request from the Ministry the licence for providing services. The request shall be submitted to the Ministry in a set forth form. The licence shall be issued by the Ministry based on approval of the Commission for each particular activity with validity term not exceeding twelve months and the licence can not be extended. The Ministry shall deny the request for issuing of licence for brokering services if the Commission identifies that the issuing of the requested licence would be in conflict with the foreign policy or economic interest of the Republic of Croatia and the EU Rules of Conduct for export of weapons.
A prison sentence of one to five years shall be imposed on persons found by the judicial bodies of the Republic of Croatia to have provided brokering services without licence issued by the Ministry of the Economy, Labour and Entrepreneurship. If a criminal offence has caused the death of more persons or inflicted large-scale damage, the offender shall be sentenced to at least five years of imprisonment. The same punishment shall be imposed on a natural person - individual engaged in brokering services without the licence issued by the Ministry. The penalties range from HRK 10,000.00 to 100,000.00.
