Draft Proposal on Adoption of the Law on Weapons
I. Constitutional Bases for Adoption of The Law
Constitutional bases for adoption of the Law on weapons derive from Article 68 paragraph 1 item 2 of the Constitution of Republic of Macedonia, upon which the Parliament of Republic of Macedonia adopts laws.
II. Reasons why is Proposed Adoption of the Law
In the legislation of Republic of Macedonia, purchasing, possession and carrying weapons is determined with the Law on purchasing, possession and carrying of weapons ("Official gazette of SRM" number 25/72, 30/72, 18/76, 25/76, 15/83, 51/88, "Official gazette of RM" number 26/93 and 49/03).
Dispositions of this law are not enough precise and do not correspond with international instruments and legislations of countries of European Union, and their practical use faces difficulties in functioning of appropriate state bodies.
Negative trend of increasing of crime in Republic of Macedonia, including illegal possession of weapons and explosive materials and clear expansion of the number of committed crime acts with elements of violence, executed with the use of fire weapons which executors posses illegally, is determine the readiness and political will for mobilizing all controlling mechanisms and increasing of their efficiency in preventing and crushing the crime.
Because of this reasons is imposed the need for updating and advancing the legislation with adoption of the Law on weapons, by which will be implemented international standards, as well as comparative experience of western European countries that deal with controlling the weapons, reason why we propose to the Parliament of Republic of Macedonia to adopt this law.
III. Basic Principles Upon which shoud be Founded Basic Relations
Regulated by the Law
The draft proposal for adopting the Law on weapons is based upon the following principles:
- set by regulations the purchasing, production and trading with weapons and ammunitions;
- control over purchasing and possession, production and trading with weapons and ammunitions;
- Limiting the freedom in the market and entrepreneurship and trading with weapons and ammunition, in order to protect the health of people and the environment.
[According to the Republic of Macedonia's 2009 Report on the Implementation of the UN Programme of Action on Small Arms and Light Weapons, these draft provisions were adopted by the Parliament of the Republic of Macedonia on 8 February 2005.
