The Supreme Court found that the directive from Garda Headquarters imposing a storage pre-condition interfered with the persona designata status of a Garda Superintendent.

The Court also found that a Superintendent imposing such a condition would be acting ultra vires in that there was not a requirement for secure storage in the legislation.
