Art 17 Trade in Arms
1 Any person who, in a professional capacity, acquires, offers or passes on to third parties arms, essential components of arms, specially designed components of arms, accessories of arms, ammunitions or components of ammunitions, or carries out brokerage of these must hold a licence to trade in arms.
2 A licence to trade in arms is issued to any person:
a. against whom no objections can be raised for the reasons as referred to in art. 8, para. 2;
b. who is recorded in the trade register;
c. who has passed an examination attesting that he has sufficient knowledge of the different types of arms, ammunitions and the legal provisions relating to these;
d. who has special commercial premises in which arms, essential components of arms, specially designed components of arms, accessories of arms, ammunitions and components of ammunitions can be stored in full safety;
e. who offers all guarantees of irreproachable commercial management.
3 Legal entities are bound to designate a member of management who, within the firm, is responsible for all questions linked to this law.
4 The Federal Department of Justice and Police lays down the regulations for the examination and fixes the minimum requirements relating to the commercial premises.
5 The licence to trade in arms is issued by the competent authority for the Canton in which the requester has established his firm's headquarters. The branches established outside this Canton must obtain their own licence to trade in arms.
6 The Federal Council fixes the conditions of participation in public arms exchanges for holders of foreign licences to trade in arms.
7 If a transfer takes place between persons in possession of a licence to trade in arms, the transferor must inform the competent authority for his Canton of ordinary residence within 30 days as of the signing of the contract of sale; he must inform the latter, in particular, of the type and number of transferred objects.
