Regulations of Non-Combat Firearms Purchase
Each citizen of Azerbaijan Republic over the age of 18 has a right to a civilian firearm.
A citizen willing to purchase a civilian firearm may apply through the local police body where he lives or through the Head Office of Public Security of the Ministry of Internal Affairs.
A special license is given for purchasing an arm. The following documents should be submitted to get said license:
- Application (form taken from police body is filled)
- Identity Card confirming the citizenship of Azerbaijan Republic;
- Medical reference about health condition;
- Two photos in 3x4 size
Inspection of persons by state bodies is not carried out.
For issuing a license for the purchase of a civilian firearm, membership to a hunters society is not required.
Foreigners should present an identity card and a solicitation letter from the embassy of the state that they are a citizen of. In such cases, medical references are not presented and their previous convictions are not checked.
Foreigners should export the civilian firearm from Azerbaijan Republic within 5 days after they receive the special license. If the means of transportation of the firearm is delayed, it will be confiscated.
The period of validity of the special license issued for purchasing civil arm is 6 months. The following data should be stated on the special license:
- The name, surname, patronymic of the person purchasing the firearm, the type of arm, quantity, the date of issuance of the license and the validity period.
- Correspondant notes about the mark, calibre, and serial number of the arm are provided on the backside of the license issued by the trade organization. For the purchase of a civilian firearm, it is given to the citizen only after it is signed and certified by seal.
The citizen should register the firearm or sporting arm within two weeks. The certificate confirming the maintenance and right of use of the firearm or sporting arm and its destination is issued to the holder of the registered arm.
When issuing the certificate confirming the maintenance and right of use of the firearm or sporting arm, the receipt about the deduction of state duty in the sum of a decimal fraction of standard unit is required.
The period of validity of the certificate confirming the citizen's right of the maintenance and use of the arm is 3 years.
Application of citizen, special license issued for holding arm, taking and appointment, receipt approving payment of stated duty in 5 fractional amount of financial unit for arm and repeat registration is submitted for prolonging it till being 3 months to termination of validity period [sic]. The application is considered for 1 month from its issuance. Special licenses are prolonged for a 3 year period.
Special licenses for purchasing, owning, carrying and using a self-defense gas arm (pistols, revolvers) is carried out under the general rules for purchasing, owning, carrying and using firearms
Once a citizen has submitted an application, a certificate is issued by the Head Office of Public Security (HOPS) for to use for holding, taking and appointment of the same arm.
A certificate for holding such firearms is issued to the citizen without dedicating state duty, showing validity period and with the writing "awarded."
Arms banned in Azerbaijan Republic can't be awarded.
If an awarding arm is in military appointment or its bearer is dead, it shall be given to the police immediately by his/her relatives without payment. Hunting arms are given to the police within 10 days by relatives of the dead person; changing of registration of arm or selling with agreement of his/her relatives is considered.
Changing of the registration of a civilian firearm from one person to another is permitted. In such case, applications are submitted by both parties. The registration is changed and the government records are ammended. When it is confirmed that an arm is in unfit condition (in that its repair is impossible), its registration can't be changed. Such arms are handed over to the police without payment and taking out of the registration.
A citizen can inherit a civilian firearm granted they have a license and are the subject of a written will.
In the case of inheritance, if the heir/heiress isn't licensed, he/she must get a license within 3 months. If the heir/heiress doesn't want to get a license or fails to do so, he/she will present the same arm to another, turn over to the police, or sell.
When citizens possessing firearms change living places, they shall inform the police about this for ammendment of the registration, supply their new address, appeal to the local police in the new living place within 10 days and re-register the weapon.
A person licensed to acquire a weapon with a certificate approving the right to possess hunting or sporting firearms and use for that purpose can acquire a hunting firearm without a license.
A license issued for possessing and carrying a firearm is considered a basis for acquiring hunting side-arms.
A certificate approving the right of a citizen to possess a hunting or sporting firearm for such purposes grants them the right to acquire ammunition for the operation of that weapon.
A license for acquiring a tire arm or aerosol [sic] isn't required. Trade enterprises can sell tire and self-defense arms (including aerosol) to citizens over the age of 18 based on their identity card and record of the transfer.
A citizen possessing a hunting firearm without rifled in using more than five years and not breaching rules concerning with turnover of arm, partner of arm groups having license to holding and taking of arm have right to get, hold and to use for its appointment of rifled barrel weapon [sic].
The issuing of a license for acquiring a civilian firearm is rejected in the following cases:
- Except for collectors, already possesses 7 firearms;
- Is medically diagnosed with alcoholism, narcotism, blindness, or mental illness;
- Has a criminal record involving firearms;
- Has been officially penalized for breaching hunting and fishing laws, acquiring or possessing military firearns or ordnance, breaching social laws and certained management laws, and posing any other danger involving firearms or ammunition (for a 1 year period);
- Being in prophylactic and operation registration in police department [sic];
- Deemed completely or partially disabled by a valid decision of court;
- Possessing an unknown firearm;
- Living place isn't determined.
