Article 136

Les armes, munitions et leurs éléments des catégories A11 et B2 ou mentionnés aux a, b et c du 1° de la catégorie C3 dont le transfert est soumis à autorisation en application du présent chapitre et qui figurent dans la liste de produits liés à la défense prévue à l'article L. 2335-9 du code de la défense sont dispensés de la procédure d'autorisation de transfert de produits liés à la défense prévue à ce même article.

Pour des raisons de respect des engagements internationaux de la France, de protection des intérêts essentiels de sécurité, d'ordre public ou de sécurité publique, le transfert à destination d'un autre Etat membre des armes, munitions et leurs éléments mentionnés au premier alinéa peut être soumis à la procédure prévue à l'article L. 2335-9 du code de la défense par arrêté conjoint du Premier ministre et des ministres des affaires étrangères, de l'économie et des finances, de la défense et de l'intérieur ainsi que du ministre chargé des douanes.

Decree No. 2013-700 of 30 July 2013 on the Implementation of the Act No. 2012-304 of 6 March 2012 on the Establishment of a Modern, Simplified and Preventive Control of Weapons

Article 136

Firearms, ammunition and their components of categories A11 and B,2 or mentioned in a), b) and c) of 1° of category C,3 whose transfer is subject to the authorisation referred to in the present chapter, and that are listed among products related to defence under Article L. 2335-9 of the Code of Defence, are exempted from the procedure of the transfer authorisation for the products related to defence provided for in the same article.

For reasons of compliance with France's international commitments, for the protection of essential security interests, public order or public security, any transfer to another Member State of firearms, ammunition and their components mentioned in the first paragraph, may be subject to the procedure provided for in Article L. 2335-9 of the Defence Code by a joint order of the Prime Minister and of the Ministers of Foreign Affairs, Economy and Finances, of Defence and of the Interior as well as the Minister in charge of Customs.
