Article 10

Les autorisations mentionnées aux articles 26 à 28,1 32 à 342 3 4 et aux articles 36 et 56 sont délivrées, dans chaque cas, par les autorités suivantes:

1° Pour les autorisations portant sur les matériels de la catégorie A25 susceptibles d'être déclassés, par le préfet du département où se trouve le siège de l'entreprise ou le domicile de la personne demanderesse, dans les conditions prévues par un arrêté conjoint des ministres de la défense et de l'intérieur;

2° Pour les autorisations mentionnées à l'article 32, par le préfet du département dans lequel se trouve le siège de l'entreprise ou de l'établissement pour les entreprises de convoyage de fonds ou par le préfet du département où est implanté l'établissement qui se trouve dans l'obligation d'assurer la sécurité de ses biens;

3° Pour les autorisations mentionnées à l'article 26, par le préfet du département dans lequel se trouve situé le siège de l'entreprise ou du théâtre national;

4° Pour les autorisations mentionnées aux 1° et 2° de l'article 34, par le préfet du département du lieu de domicile ou du siège de l'association;

5° Pour les autorisations mentionnées à l'article 36, par le préfet du département de la commune de rattachement ou, en cas d'implantation supérieure à trois mois, du lieu d'implantation de la manifestation;

6° Pour les autorisations mentionnées aux articles 33 et 56, par le préfet du département du lieu de domicile;

7° Pour les autorisations mentionnées à l'article 27, par le préfet du département dans lequel se trouvent situés le musée, autre qu'un musée de l'Etat, le siège de la personne morale ou de l'établissement d'enseignement ou le domicile de la personne physique.
Lorsque le matériel de guerre est classé au titre des monuments historiques, la décision est prise après avis du ministre chargé de la culture;

8° Pour les autorisations mentionnées à l'article 28, par le préfet du département dans lequel se trouvent situés le siège de l'entreprise ou ses établissements.

Article 10

The authorisations mentioned in Articles 26 to 28,1 32 to 342 3 4 and in Articles 36 and 56 are issued, in each case, by the following authorities:

1° For the authorisations concerning materials of category A25 likely to be decommissioned, by the Prefect of the department of the company's headquarters or the residence of the applicant, under conditions listed by a joint order of the Ministers of Defence and of the Interior;

2° For the authorisations mentioned in Article 32, by the Prefect of the department of the company's headquarters or the establishment for fund transport companies or by the Prefect of the department where is located the establishment in charge of ensuring the safety of these goods;

3° For the authorisations mentioned in Article 26, by the prefect of the department of the company's headquarters or of the national theatre;

4° For the authorisations mentioned in 1° and 2° of Article 34, by the prefect of the department of the association's residence or headquarters;

5° For the authorisations mentioned in Article 36, by the Prefect of the department of the local township, or, in case of event lasting longer than three months, of the place of the event;

6° For the authorisations mentioned in Articles 33 and 56, by the Prefect of the department of the place of residence;

7° For the authorisations mentioned in Article 27, by the Prefect of the department of the museum, other than a State museum, the headquarters of the legal person or the educational establishment or the residence of the individual.
When the material of war is listed and classified by the French Historic Monument, the decision is taken after consultation with the Minister in charge of Culture;

8° For the authorisations mentioned in Article 28, by the Prefect of the department of the headquarters of the company or of its establishments.
