Article 128

Des dérogations aux dispositions des deuxième à quatrième alinéas de l'article 1271 peuvent être accordées par le ministre de la défense pour les expéditions d'armes transférées au sens du chapitre VII, importées ou exportées, après avis du ministère de l'intérieur et, s'il y a lieu, d'autres ministères intéressés. Les décisions accordant ces dérogations peuvent imposer des mesures de sécurité renforcées à la charge des bénéficiaires.

Decree No. 2013-700 of 30 July 2013 on the Implementation of the Act No. 2012-304 of 6 March 2012 on the Establishment of a Modern, Simplified and Preventive Control of Weapons

Article 128

Exemptions to the provisions of the second to the fourth paragraphs of Article 1271 may be granted by the Minister of Defence for shipments of firearms transferred as defined in Chapter VII, imported or exported, after notification to the Minister of the Interior and, if applicable, to other concerned ministries. The decisions granting these exemptions may impose tighter safety measures at the expense of the beneficiaries.
