Article 46

Toute personne physique qui acquiert ou qui cède en France auprès d'un armurier ou à un armurier, ou d'un particulier ou à un particulier en présence d'un armurier, une arme ou un élément d'arme de la catégorie C1 ou du 1° de la catégorie D2 procède, pour une arme de la catégorie C à une déclaration, sur l'imprimé conforme au modèle fixé par l'arrêté prévu à l'article 6 et pour une arme du 1° de la catégorie D à une demande d'enregistrement.

Cette déclaration pour les armes de la catégorie C et cette demande d'enregistrement pour les armes du 1° de la catégorie D sont transmises par l'armurier au préfet du département du domicile du déclarant. Elles sont accompagnées d'une copie d'un permis de chasser délivré en France ou à l'étranger ou de toute autre pièce tenant lieu de permis de chasser étranger ainsi que d'un titre de validation de l'année en cours ou de l'année précédente ou, dans les conditions du 4° du II de l'article 12,3 d'une licence d'une fédération sportive ayant reçu, au titre de l'article L. 131-14 du code du sport, délégation du ministre chargé des sports pour la pratique du tir.

La présentation de l'un des titres prévus à l'alinéa précédent supplée à la production du certificat médical mentionné à l'article L. 312-64 du code de la sécurité intérieure.

Le vendeur adresse à la préfecture auprès de laquelle il avait déclaré ou enregistré l'arme une copie de la demande de déclaration ou d'enregistrement.

Pour les armes du 3° de la catégorie C la déclaration peut être accompagnée du seul certificat médical mentionné à l'article L. 312-6 du code de la sécurité intérieure, placé sous pli fermé, datant de moins d'un mois, attestant que l'état de santé physique et psychique du déclarant n'est pas incompatible avec leur détention.

Article 46

Any individual who purchases or transfers in France from or to a gunsmith [armourer], or from or to an individual in the presence of a gunsmith, a firearm or component of a firearm of category C1 or of 1° of category D,2 must declare it, as a firearm of category C, on the form in accordance to the model set by the order under Article 6, and must submit a registration request for a firearm of the 1° of category D.

This declaration for firearms of category C or this registration request for firearms of the 1° of category D are transferred by the gunsmith [armourer] to the Prefect of the place of residence of the declarant. A copy of a hunting permit issued in France or abroad, or of any other document in lieu of a foreign hunting permit, as well as credentials of the current year or of the past year or, under provisions of the 4° II of Article 12,3 a licence from a sports federation that has received, under Article L. 131-14 of the Sports Code, delegation from the Minister in charge of Sports for the practice of shooting, must be attached to the declaration or to the registration request.

Presentation of one of the documents provided for in the previous paragraph compensates [substitutes] for the production of the health certificate mentioned in Article L. 312-6 of the Internal Security Code.

The seller must address to the Prefecture, where he had declared or registered the firearm, a copy of the declaration or registration request.

For firearms of the 3° of category C, the declaration may only be joined by a health certificate, referred to in Article L. 312-64 of the Internal Security Code, placed in a sealed envelope, dated less than a month before, attesting that the physical and psychiatric state of the purchaser is not incompatible with their possession.
