Articulo 4. Clasificación de Armas

1.Armas de fuego de uso militar:

a) Pistolas y revólveres en todos los calibres;
b) Fusiles, ametralladoras, armas semiautomáticas y automáticas, en todos los calibres…
f) Otras armas de fuego de uso militar.

2.Armas de fuego de uso policial:

a) Revólveres hasta calibre 38;
b) Pistolas y subametralladoras semiautomáticas hasta el calibre 9 mm;
c) Carabinas de repetición o semiautomáticas .30;
d) Escopetas y pistolas antidisturbios;
e) Fusiles semiautomáticos y automáticos para unidades especializadas de la Policía Boliviana, destinadas a combatir el crimen organizado, previa autorización del Ministerio de Defensa del Estado Plurinacional;
f) Otras Armas de fuego de uso policial.

3. Armas de fuego de uso civil:
a) Armas individuales para defensa personal: Son aquellas pistolas, revólveres y rifles de calibre .22 corto, largo y magnum;
b) Armas de caza: Son aquellas escopetas en todos sus calibres de ánima lisa de cañón simple o doble, estos últimos superpuestas o yuxtapuestas, que conserven sus características técnicas de fabricación original y que son utilizadas para garantizar el sustento alimenticio propio y/o de la familia y para realizar actividades de caza con fines comerciales y de control de especies animales debidamente autorizadas por Autoridad Ambiental competente, en cumplimiento a la normativa ambiental vigente;
c) Armas deportivas: Son aquellas armas cortas y largas, de cajón rayado o liso, monotiro, de repetición o semiautomáticas, de percusión central o anular, reglamentadas por los organismos nacionales e internacionales de tiro con fines deportivos. Serán utilizadas únicamente en eventos deportivos y/o polígonos autorizados;
d) Armas antiguas, históricas y de colección:
d1. Armas antiguas: Fabricadas antes de mil ochocientos noventa y nueve (1899), de propiedad del Estado o privadas, autorizadas por el Ministerio de Gobierno y registradas en el Registro de Armas de Fuego y Municiones de Uso Civil- REAFUC;
d2. Armas históricas: Son declaradas expresamente, conforme establece la normativa vigente, previa certificación emitida por el laboratorio de pruebas y la Academia Boliviana de Historia Militar. Se constituyen en patrimonio histórico del Estado y deben registrarse ante los Ministerios de Defensa y de Culturas;
d3. Armas de colección: Son autorizadas para la tenencia y transporte con fines de exposición por el Ministerio de Gobierno…

Las armas establecidas en el numeral 3 del presente Articulo unicamente podran ser adquiridas y utilizadas para fines de defensa personal, deportivos, caza, coleccion y de exposición, pudiendo ser sujetas a secuestro o incautación por parte de la policía Boliviana, cuando se las destine a otros fines.

Article 4. Classification of Weapons

1. Firearms for military purposes:

a) Pistols and revolvers of any calibre;
b) Rifles, machine-guns, automatic and semi-automatic firearms of any calibre…
f) Other firearms for military use.

2. Firearms for police use:

a) Revolvers up to .38 calibre ;
b) Semi-automatic pistols and sub-machine guns up to 9mm calibre;
c) Repeating or semiautomatic carbines [of calibre] .30;
d) Riot shotguns and pistols;
e) Semi-automatic and automatic rifles for specialised units of the Bolivian Police, tasked to combat organised crime, upon authorisation of the Ministry of Defence of the Plurinational State;
f) Other firearms for police use.

3. Firearms for civilian use:

a) Individual firearms for personal defence: pistols, revolvers and rifles of .22 calibre, short, long or magnum;
b) Hunting firearms: shotguns of any calibre with single or double smooth bore barrels, be these over-and-under or side-by-side, which conserve their original technical manufacturing features and are used to guarantee the food-subsistence of an individual and/or their family and to carry out hunting activities for commercial purposes and animal species control duly authorised by the competent Environment Authority in compliance with current environmental norms;
c) Sporting firearms: those firearms, short and long, with a rifled or smooth bore barrel, single-shot, repeater or semi-automatic, center fire or rimfire, regulated by national and international sporting institutions. They shall only be used in sporting events and/or authorised shooting ranges.
d) Antique, historical and collectable firearms:
d1. Antique firearms: manufactured before eighteen ninety nine (1899), state-owned or private, authorised by the Ministry of the Interior and registered in the Register of Firearms and Ammunition for Civilian Use (REAFUC).
d2. Historical firearms: firearms are declared historical, in accordance with the respective legislation, upon a certificate issued by the tests laboratory and the Bolivian Academy of Military History. They form part of the historical heritage of the State and must be registered with the Ministries of Defence and Culture.
d3. Collectable firearms: their ownership and transport for exhibition purposes are [to be] authorised by the Minister of the Interior…

Firearms referred to in paragraph 3 of this Article may only be purchased and used for personal defence, sports, hunting, collection and exhibition purposes, and they may be subject to confiscation or seizure by the Bolivian Police whenever they are put to other uses.
