Artículo 88. Infracciones gravísimas

Son infracciones gravísimas1 2 a esta Ley:

1. Portar, tener o almacenar armas de fuego o municiones prohibidas sin ningún tipo de licencia o certificación expedido por la DIASP.
2. Emplear armas de fuego sin la correspondiente licencia en la comisión de cualquier hecho punible.
3. Comercializar armas de fuego prohibidas por la ley.
4. Comercializar armas de fuego sin la autorización correspondiente o incumpliendo las normas establecidas en esta Ley.
5. Vender armas de fuego en un establecimiento autorizado sin exigir la presentación de la respectiva licencia para el uso de armas de fuego.
6. Vender municiones para armas de fuego autorizadas por esta Ley sin la presentación del respectivo certificado de tenencia o la licencia para portar arma de fuego por su titular.
7. Recargar municiones sin certificado de tenencia de armas de fuego ni licencia para portar arma de fuego que justifique tal actividad.
8. Importar o introducir al país armas de fuego, municiones, cartuchos de escopeta y/o materiales relacionados sin autorización oficial prevía.
9. ·Realizar modificaciones en el mecanismo de funcionamiento del arma para su conversión en automática.
10. Reparar reductores, supresores o silenciadores de ruido.
11. Transportar armas o municiones o materiales relacionados sin la autorización correspondiente.
12. Operar un polígono de tiro sin la licencia respectiva.
13. Operar un taller de armería sin el permiso correspondiente.
14. Utilizar armas de fuego cuyo uso esté prohibido a particulares por esta Ley.
15. Portar armas de fuego en estado de ebriedad o bajo los efectos de sustancias psicotrópicas, conforme a dictamen facultativo, aun cuando se lleve consigo la correspondiente licencia.
16. Reincidir en la comisión de infracciones graves en un periodo de un año.

Article 88. Very Serious Offences

[The following are considered] very serious offences1 2 under this Act:

1. To carry, possess, or store firearms or ammunition without any type of licence or certificate issued by DIASP.
2. To use firearms without the relevant licence to commit any offence.
3. To trade in firearms prohibited by this Act.
4. To trade in firearms without the relevant authorisation or in breach of provisions established in this Act.
5. To sell firearms in an authorised establishment without requiring presentation of the relevant licence for firearm use.
6. To sell ammunition for firearms authorised by this Act without requiring the owner's relevant possession certificate or licence to carry firearms.
7. To reload ammunition without a firearm possession certificate, nor a licence to carry firearms, which could justify such activity.
8. To import or bring into the country firearms, ammunition, cartridges for shotguns and/or related materials, without prior official authorisation.
9. To modify the functioning mechanism of a firearm to convert it to automatic fire.
10. To repair noise reducers, suppressors or silencers.
11. To transport firearms or ammunition, or related materials, without the relevant authorisation.
12. To run a shooting range without the relevant licence.
13. To run a repair shop [armoury], without the relevant permit.
14. To use firearms in a manner prohibited to individuals by this Act.
15. To carry firearms while intoxicated or under the influence of psychotropic substances, according to a medical report, even while holding a licence.
16. To commit a subsequent very serious offence within a period of one year.
