Artículo 21. Funciones de la DIASP

Para la regulación de la comercialización, tenencia y porte de armas de fuego, municiones y materiales relacionados, la DIASP tendrá las siguientes facultades:

1 . Emitir las licencias y certificados establecidos en esta Ley, previo cumplimiento de los requisitos previstos para cada caso.
2. Fiscalizar y supervisar el funcionamiento de establecimientos que se dediquen a la comercialización, importación y exportación de armas de fuego, municiones y materiales relacionados, previamente autorizados por el Ministerio de Seguridad Pública.
3. Autorizar, fiscalizar y supervisar el funcionamiento de polígonos de tiro, armerías y máquinas para recargar municiones.
4. Autorizar y supervisar la tenencia de armas de fuego que pertenezcan a las empresas de seguridad privada y el porte de estas por sus trabajadores, con licencia para portarlas, en apego a esta Ley.
5. Supervisar el inventario fisico de las armas de fuego, municiones y materiales relacionados que se encuentren en los establecimientos comerciales, lugares de depósito, polígonos de tiro y armerías.
6. Realizar los exámenes técnicos y periciales a los solicitantes de certificados de tenencia y licencias de porte de armas, por primera vez.
7. Colaborar con el Ministerio de Seguridad Pública para diseñar y planificar estrategias y medidas para erradicar el tráfico y circulación ilícita de armas de fuego en el país.
8. Proponer al Ministerio de Seguridad Publica programas y proyectos orientados a promover la entrega voluntaria de armas de fuego no registradas.
9. Promover las denuncias ante la autoridad competente cuando se tenga conocimiento de la posible comisión de un delito.
10. Remitir al ministro de Seguridad Pública y al director de la Dirección de Investigación Judicial informes mensuales sobre licencias de porte y certificados de tenencia otorgados para el uso de armas de fuego.
11. Cumplir y hacer cumplir esta Ley y su reglamento.
12. Ejercer las demás que le sean asignadas en la ley.

Article 21. Functions of DIASP

Regarding the commerce, possession and carrying of firearms, ammunition and related materials, DIASP has the following powers:

1. Issue licences and certificates set in this Act, subject to the fulfillment of requirements set for each case.
2. Control and supervise the functioning of establishments dedicated to the trade, import and export of firearms, ammunition and related materials, [establishments that are] previously authorised by the Ministry of Public Security.
3. Authorise, control, and supervise the functioning of firing ranges, armouries and machinery intended for the reloading of ammunition.
4. Authorise and supervise the possession of firearms belonging to private security companies and the carrying of these by their employees, with a licence to carry them, in compliance with this Act.
5. Physically supervise the inventory containing firearms, ammunition, and related materials that are kept in commercial establishments, storage premises, firing ranges and armouries.
6. Conduct a technical and expertise exam for first time applicants for a certificate to possess and/or a licence to carry firearms.
7. Collaborate with the Ministry of Public Security to design and plan strategies and means to eradicate trafficking and illicit circulation of firearms in the country.
8. Suggest to the Ministry of Public Security programmes and projects to promote the voluntary surrender of non-registered firearms.
9. Notify the competent authority when there is knowledge of the possible commission of a crime.
10. Submit to the Ministry of Public Security, and to the Director of the Judicial Investigation Department, monthly reports on licences to carry granted and certificates to possess firearms granted.
11. Comply with and enforce this Act and its regulations.
12. Exercise such other functions as may be assigned by law.
