Artículo 12. Prohibición de porte y tenencia

Se prohíbe la tenencia y porte de armas de fuego a las siguientes personas:

1. Las menores de veintiún años para porte y menores de dieciocho años para tenencia.
2. Las declaradas en estado de interdicción.
3. Las que no hayan aprobado una prueba psiquiátrica o psicológica en los últimos seis meses para comprobar su capacidad para la responsable tenencia y/o porte de armas de fuego.
4. Las identificadas mediante certificación médica en los últimos tres meses como consumidores de drogas o sustancias psicotrópicas.
5. Las que conforme a su historial policivo han sido reiteradamente detenidas en estado de ebriedad, procesadas o multadas por reincidir en conducir vehículos automotores, participar en riñas y en la promoción de actos de violencia doméstica. Estas personas serán consideradas como beodas habituales por la autoridad competente y no se les expedirá permiso para portar ni poseer annas de fuego.
6. Las inimputables de acuerdo con la legislación penal.
7. Las condenadas por un tribunal competente por delitos contra la vida y la integridad personal, delitos contra la libertad, delitos contra la libertad e integridad sexual, delitos contra el orden jurídico familiar y el estado civil, delitos contra el patrimonio económico, delitos contra la seguridad colectiva, delitos contra la personalidad jurídica del Estado y delitos contra la humanidad. En estos casos, la autoridad competente deberá notificar inmediatamente a la DIASP de la respectiva condena.
8. Las demás a las que les esté prohibido por decisión judicial.

Article 12. Ban on Carrying and Possession

The possession and carrying of firearms by the following persons are prohibited:

1. Those that are less than twenty-one years of age for carrying and those of less than eighteen years old for possession.
2. Those declared as prohibited.
3. Those who have not passed a psychiatric or psychological test in the past six months to check their capacity for the responsible possession and/or carrying of firearms.
4. Those identified by a medical certificate within the past three months as consumers of drugs or psychotropic substances.
5. Those who, according to their police records, have been repeatedly detained while intoxicated, prosecuted or fined for committing a subsequent offence while driving motor vehicles, participating in fights and perpetrating acts of domestic violence.
6. Those criminally responsible under criminal law.
7. Those sentenced by a competent court for crimes against life or personal integrity, crimes against liberty, crimes against sexual liberty or integrity, crimes against the family or marital status, crimes against economic property, crimes against public safety, crimes against the State and crimes against humanity. In these cases, the competent authority must immediately notify DIASP of the corresponding sentence.
8. And others prohibited by court order.
